Về Những Vi Phạm Nhân Quyền Của Nhà Cầm Quyền Cộng Sản Việt Nam
XÉT RẰNG:
Kể từ ngày 30-4-1975, đảng Cộng Sản Việt Nam tiếp tục áp đặt một chế độ độc đảng tại Viêt Nam, hoàn toàn kiểm soát xã hội về mọi lãnh vực; tước bỏ các quyền làm người căn bản; xóa bỏ mọi quyền tự do công dân; xử dụng hệ thống tư pháp bất công do đảng cộng sản kiểm soát và khống chế; áp dụng các điều khoản 88 và 258 luật hình sự để bắt bớ, giam cầm, xét xử công dân một cách tùy tiện; đàn áp những nhà hoạt động vì dân chủ, đòi tự do tôn giáo, tự do ngôn luận, chống bất công, bảo vệ sự vẹn toàn lãnh thổ trước sự xâm lăng của nhà cầm quyền CS Bắc Kinh.
Từ khi gia nhập tổ chức Liên Hiệp Quốc năm 1977, nhà cầm quyền CSVN đã không tôn trọng bản Tuyên Ngôn Quốc Tế Nhân Quyền và các Công Ước Quốc Tế về nhân quyền và dân sự.
Những ngày gần đây, ngay sau khi đắc cử vào Hội Đồng Nhân Quyền LHQ, quốc hội Việt Nam do đảng CSVN thành lập và kiểm soát đã thông qua bản hiến pháp tiếp tục xác nhận sự độc quyền cai trị của đảng cộng sản Việt Nam.
VÌ CÁC LÝ DO ĐÓ, Phái đoàn đại biểu của Cộng Đồng Người Việt Nam trân trọng kiến nghị cùng Văn Phòng Cao Ủy NQ và Hội Đồng Nhân Quyền LHQ:
Áp lực buộc nhà cầm quyền CSVN phải tuân thủ bản Tuyên Ngôn Quốc Tế Nhân Quyền; thực thi các quyền tự do của người dân Việt Nam như: Tự do lập hội, tự do ngôn luận, tự do báo chí, tự do bầu cử, công dân phải được đối xử công bằng và bình đẳng; thiết lập một hệ thống tư pháp độc lập, xét xử phù hợp với luật pháp quốc tế.
Trả tự do tức khắc và vô điều kiện tất cả tù nhân chính trị, tù nhân tôn giáo, tù nhân lương tâm... hiện đang bị sách nhiễu, tù đày, giam cầm bởi chế độ cộng sản tại Việt Nam; hủy bỏ những bản án bất công và các điều khoản 258 và 88 của bộ luật Hình Sự. Hủy bỏ những điều khỏan được gọi là “an ninh quốc gia”, đặc biệt là các điều 79,87, 88, 89 và 258 trong Luật Hình Sự hiện nay của Việt Nam. Bỏ Nghị Định 174/2013/ND-CP (đòi phạt 100 triệu cho ai nói xấu nhà nước, có hiệu lực từ 15/1/2014).
Gửi một phái đoàn NQ/LHQ đặc biệt đến Việt nam điều tra tình trạng vi phạm nhân quyền của nhà nước CHXHCNVN.

PETITION
To UN High Commissioner for Human Rights and UN Human Rights Council
Regarding Human Rights Violations in Vietnam
WHEREAS:
1- Since April 30, 1975, the Vietnamese Communist Party (VCP) has maintained a totalitarian regime in Vietnam; it has not respected the human rights of the people; It eliminated all basic freedom of citizens; its oppressed, persecuted, imprisoned all activists for democracy and for protecting independence of Vietnam on the verge of the invasion threat from the North;
2- When joining the United Nations in 1977, the communist government of Vietnam has approved the Universal Declaration of Human Rights and the International Covenant on Human Rights and Civil Rights but it has never kept its promises;
3- Recently, after elected into UN Human Rights Council, the Vietnamese Assembly which was formed and controlled by the Vietnamese Communist Party, passed the Constitution with the Article 4 which asserts the one-party controlled state of Vietnam.
THEREFORE, we, the Vietnamese Community Delegates for Human Rights from around the world, respectfully petition to the UN High Commissioner for Human Rights and UN Human Rights Council:
1 – To put pressure on the government of Vietnam:
To implement the U.N. Universal Declaration of Human Rights and to respect the fundamental liberties of the people of Vietnam;
To fulfill 14 promises during applying for Human Rights Council seat;
To release immediately without conditions all political prisoners, prisoners of religion and prisoners of conscience... and those are under house arrest in Vietnam;
To cancel all unjust judgments;
To repeal injustice articles so-called “National Security” , especially the articles 79,87, 88, 89 and 258 of the Penal Code, and the Decree 174/2013/ND-CP (to fine of 100 million Vietnam Dong for anybody to speak ill to the government will be effective on 15/1/2014).
2 - To send a special delegation to Vietnam to investigate the human rights violations in this country;
