Hôm qua, ngay sau khi Quốc hội Việt nam thông qua Luật biển, bộ Ngoại giao Trung Quốc triệu đại sứ Việt Nam tới nghe phản đối. Theo giới phân tích, pha biểu diễn « cơn thịnh nộ của thiên triều » không dọa được dân chúng Việt Nam, mà còn cho thấy Bắc Kinh e dè pháp lý, một nhược điểm của kẻ chỉ biết dùng sức mạnh.
Theo phân tích của nhật báo Mỹ The New York Times, trong một « pha biểu diễn quyết tâm » đối đầu với mọi tranh chấp tại « Nam Hải », Trung Quốc đã đả kích một cách mạnh mẽ Việt Nam thông qua Luật biển khẳng định chủ quyền trên quần đảo Hoàng Sa và Trường Sa.

Ngay sau khi Luật biển được Quốc hội Việt Nam thông qua, đại sứ Nguyễn Văn Thơ tại Bắc Kinh đã bị bộ ngoại giao Trung Quốc triệu mời nghe phản đối « luật biển Việt Nam tuyên bố chủ quyền tại Tây Sa và Nam Sa là một sự vi phạm nghiêm trọng chủ quyền của Trung Quốc » và « Trung Quốc cực lực chống lại ».
Đây là lần đầu tiên Việt Nam trang bị cho mình một vũ khí pháp lý bảo vệ biển đảo sau khi Hoàng Sa bị Trung Quốc đánh chiếm vào năm 1974 lúc đất nước phân đôi và một phần Trường Sa bị rơi vào tay Trung Quốc năm 1988.
Dự luật này đã bị dời đi dời lại nhiều năm liền trước khi bất ngờ được biểu quyết hôm qua 21/06/2012. Trong những ngày qua, giới thạo tin tại Hà Nội còn báo động là Bắc Kinh gây sức ép để ngăn chận.
Thái độ giận dữ của Trung Quốc được biểu lộ hai tuần trước khi diễn ra hội nghị cấp ngoại trưởng của Hiệp Hội Asean tại Phom Penh, mà trong đó có sự tham dự của ngoại trưởng Mỹ Hillary Clinton. Theo New York Times, hồ sơ tranh chấp biển Đông sẽ là một chủ đề trong chương trình nghị sự.
Bắc Kinh cũng gấp rút ban hành một số biện pháp hành chánh trong mưu toan đặt quốc tế và các nước láng giềng trước sự đã rồi : tuyên bố nâng cấp địa bàn gồm Hoàng Sa và Trường Sa của Việt Nam ( mà Trung Quốc gọi là Tây Sa và Nam Sa) và đảo Macclesfield Bank của Philippines ( mà Trung Quốc gọi là Trung Sa ), thành « Địa cấp Tam sa thị », lớn hơn huyện nhưng nhỏ hơn tỉnh.
Cũng trong kế hoạch biến Biển Đông thành ao nhà, Trung Quốc tiếp tục duy trì tàu ngư chính và tàu đánh cá bên ngoài vùng bãi đá ngầm Scarborough của Philippines, sau hơn hai tháng biểu dương sức mạnh.
Theo nhận định của New York Times, hội nghị diễn đàn an ninh khu vực tại Phnom Penh trong hai tuần tới sẽ mở ra trong bối cảnh căng thẳng tại Biển Đông và tranh giành ảnh hưởng giữa Hoa Kỳ và Trung Quốc. Trong bối cảnh này, chưa rõ Việt Nam và Philippines sẽ được Hoa Kỳ hậu thuẩn cụ thể ra sao. Nhưng Việt Nam đã chủ động đặt Trung Quốc « trước sự đã rồi », khẳng định chủ quyền biển đảo bằng một đạo luật quốc gia.
Cũng chưa biết là quân đội Việt Nam sẽ bảo vệ ngư dân và vùng đặc quyền kinh tế của Việt Nam đến đâu, nhưng ít ra những người có trách nhiệm cầm súng bảo vệ quốc gia hay đàm phán trên bàn hội nghị kể từ nay có trong tay những cơ sở pháp lý.
Trong vấn đề biển Đông, khi nói đến pháp lý, Bắc Kinh hoàn toàn không đưa ra được một chứng cứ nào để khẳng định Hoàng Sa và Trường Sa là của Trung Quốc.Có lẽ đây là lý do khiến cho Bắc Kinh « nổi cơn thịnh nộ » và de dọa chống lại luật biển của Việt Nam một cách kịch liệt.
Đối với người dân Việt Nam, nhất là những người quan tâm đến sự tồn vong của đất nước, lời dọa nạt của Bắc Kinh không làm họ lo sợ. Luật biển là ngọn gió làm giới thanh niên sinh viên lên tinh thần . Trên mạng « Nhật Ký Yêu Nước » đã xuất hiện lời kêu gọi biểu tình vào chủ nhật 01/07/2012 tại hai thành phố lớn Hà Nội và Sàigòn, như cách nay đúng một năm về trước.

Vietnam Law On Islands Draws Anger From China

BEIJING — In a show of its resolve in a dispute over the South China SeaChina sharply criticized Vietnam on Thursday for passing a law that claims sovereignty over the Paracel and Spratly Islands, saying they are the “indisputable” territory of China.
The Foreign Ministry in Beijing summoned the Vietnamese ambassador, Nguyen Van Tho, to strongly protest the new law, said a spokesman, Hong Lei.
“Vietnam’s Maritime Law, declaring sovereignty and jurisdiction over the Paracel and Spratly Islands, is a serious violation of China’s territorial sovereignty,” a ministry statement said. “China expresses its resolute and vehement opposition.”
The dispute between China and Vietnam over the law, which had been in the works for years, is the latest example of Beijing’s determination to tell its Asian neighbors that the South China Sea is China’s preserve.
The Chinese statement comes two weeks before a meeting of foreign ministers of theAssociation of Southeast Asian Nations, or Asean, in Phnom Penh, Cambodia, which will be attended by Secretary of State Hillary Rodham Clinton. The South China Sea is expected to be high on the agenda.
To reinforce its claims, China also announced that it had raised the level of governance on three island groups in the sea: the Spratlys, the Paracels and the Macclesfield Bank, known in Chinese as the Nansha, Xisha and Zhongsha Islands.
The Chinese State Council issued a statement placing the three groups of islands and their surrounding waters under the city of Sansha as a prefectural-level administration rather than a lower county-level one.
Xinhua, the state-run news agency, quoted a Ministry of Civil Affairs spokesman as saying that the new arrangement would “further strengthen China’s administration and development” of the three island groups.
China and South Vietnam fought over the Paracels and the Spratlys in 1974, and a unified Vietnam fought briefly with China in 1988 over the islands. China controls the Paracels and reefs and shoals within the Spratlys, according to the International Crisis Group, a research organization. The Macclesfield Bank comprises a sunken atoll and reefs. In another South China Sea squabble, President Benigno S. Aquino III of the Philippines said Wednesday that he would order Philippine government vessels back to the Scarborough Shoal if China did not remove its ships from the disputed area, as had been promised.
A two-month standoff between China and the Philippines at the shoal appeared to have been defused last weekend, when a typhoon forced Philippine fishing boats and a navy vessel to leave. China pledged to remove its vessels, too, the Philippines said at the time.
But this week, Philippines officials said half a dozen Chinese government vessels and fishing boats remained at the shoal. The exact position of the Chinese boats — whether they were inside the shoal’s large lagoon, or outside the lagoon in more open waters — was not clear.
The Philippine government spokesman, Raul Hernandez, said a verbal agreement between China and the Philippines applied only to the withdrawal of vessels from the sheltered lagoon, where Chinese fishermen were poaching rare corals, fish and sharks.
“The two sides are still talking about the vessels outside the lagoon,” he told a Philippine radio station.
The Asean ministerial meeting in Phnom Penh will almost certainly come under competing pressures from China and the United States over the tensions in the South China Sea.
Last month, at an Asean session in Phnom Penh in preparation for the ministerial meeting, Cambodia, which holds the chairmanship of the regional bloc and is a close ally of China, refused to allow the issuing of a statement on the need for a peaceful resolution of the disputes.
The United States is expected to urge the association to strengthen an existing code of conduct on the South China Sea, probably over China’s objections.
